Member Directory User Agreement
1. The Boone County Chamber’s grant of permission to use a mailing list is conditioned upon the terms contained in this document regarding
Limitation of advertising practices, types of use or users, products
or/and services.
2. This mailing list may not be used in connection with any communication which, in the opinion of the Boone County Chamber, would tend to mislead, misinform or deceive, or is distasteful in content or presentation.
3. The Boone County Chamber mailing list may not be used in connection with any lobbying for or against any legislation without the prior written permission of the Boone County Chamber.
4. In advance of any use of a Boone County Chamber mailing list, the user shall furnish the Boone County Chamber of Commerce with *a copy or sample of all literature, advertising, material or other matter to be mailed. The Boone County Chamber may decline to approve any portion or all of the submitted material for mailing. User shall hold the Boone County Chamber of Commerce harmless against any damages or claim of damage, costs and attorney’s fees arising out of any actual or alleged impropriety or illegality of mailed matter, or infringement of logo or Boone County Chamber name.
5. User may use any Boone County Chamber mailing list for an approved one time only use. User shall not copy the list or any portion or extract or retain any information from the list. User shall not at any time permit the Boone County Chamber member list information to pass into the hands of any other person, association, organization or company.
6. The list may be received in either a hard copy or electronic file. The list will contain the company name, contact name, and mailing address. No email addresses or phone numbers will be released.
7. User agrees to forward to the Boone County Chamber within thirty (30) days following receipt of list, any letters or other documents (or copies) containing complaints regarding the user’s mailing, the informational matter in the mailing, or the offered product or service.
8. The Boone County Chamber will make every effort to meet scheduled delivery or mailing dates, but will not be liable for any failure to meet requested or scheduled date.
9. For breach of this Agreement, user shall be liable to the Boone County Chamber for all costs and expenses incurred by the Chamber (including reasonable attorney fees and court costs.)
10. This Agreement shall be construed and interpreted in accordance with the laws in the State of Indiana.
